Welcome to Handerr.

These Terms and Conditions govern access, registration, use, commercialization, technological intermediation, contracting of services, payments, commissions, digital tools, artificial intelligence features, geolocation, reputation, communication, support, mediation, and other services related to the Handerr application and digital ecosystem.

By accessing, registering, browsing, publishing, contracting, offering services, paying, receiving payments, or using any Handerr functionality, you declare that you have read, understood, and accepted these Terms and Conditions, as well as the policies, annexes, fees, operational rules, and supplementary documents that form part of the platform.

If you do not accept these Terms and Conditions, you must refrain from using Handerr.

1. CONTRACTING PARTIES

These Terms and Conditions are entered into between:

1.1 Application Owner

Handerr App S.A., a company organized under the General Corporation Law of the Republic of Panama, hereinafter "Handerr App", owner, proprietor, or licensor of the application, brand, technological platform, software, design, functionalities, systems, content, interfaces, databases, processes, operational models, artificial intelligence, technological architecture, and other assets associated with the Handerr application.

1.2 Commercial Operator in Venezuela

Handerr Internacional S.A., a company authorized for commercialization, representation, commercial operation, management, promotion, implementation, administration of commercial relationships, and exploitation of certain commercial rights of Handerr in the territory of the Bolivarian Republic of Venezuela, under license, authorization, commercial agreement, or contractual relationship with Handerr App S.A., hereinafter "Handerr Internacional".

1.3 Users

Any natural or legal person who accesses, registers, or uses Handerr, including but not limited to:

  • users seeking services or solutions;
  • independent professionals;
  • technicians;
  • self-employed workers;
  • businesses;
  • suppliers;
  • companies;
  • commercial partners;
  • verified users;
  • advertisers;
  • service providers;
  • end customers.

Collectively, Handerr App S.A., Handerr Internacional S.A., and users may be referred to as the "Parties", as applicable.

2. NATURE OF HANDERR

Handerr is a digital intermediation technology platform that connects people who need to resolve a need with people, professionals, technicians, merchants, or suppliers who can offer a solution.

Handerr may include, among other features:

  • urgent help;
  • service search;
  • professional discovery;
  • swipe-style navigation;
  • professional profiles;
  • reputation and ratings;
  • internal chat;
  • agreements between users;
  • service listings;
  • geolocation;
  • artificial intelligence;
  • integrated payments;
  • external payment registration;
  • financing through third parties;
  • promotions;
  • internal positioning;
  • subscriptions;
  • visibility tools;
  • future connection with businesses, products, and stores.

Handerr is not an employer, general contractor, insurer, financial institution, bank, employment agency, direct provider of all published services, or absolute guarantor of the results of services performed by third parties.

Unless expressly provided in writing, Handerr acts as a technology platform that facilitates connection, organization, communication, visibility, payments, traceability, reputation, and operational support.

3. ACCEPTANCE AND SCOPE

Use of Handerr implies full acceptance of:

  • these Terms and Conditions;
  • the Privacy Policy;
  • the Payment Policy;
  • reputation rules;
  • service listing rules;
  • fee annexes;
  • promotional conditions;
  • integrated third-party policies;
  • and any supplementary document published by Handerr.

Handerr may update these terms at any time. Continued use of the platform after publication of modifications will imply acceptance of the changes.

4. ELIGIBILITY

To use Handerr, the user declares that they:

  • are at least 18 years of age or the applicable legal age of majority;
  • have sufficient legal capacity;
  • are not legally prohibited from entering into contracts;
  • provide truthful, current, and complete information;
  • will use the platform in accordance with the law, morality, public order, and these terms.

Handerr may reject registrations, suspend accounts, limit functionalities, or request additional verification when it deems necessary.

5. ACCOUNT REGISTRATION

To access certain functionalities, the user must create an account and provide information such as:

  • first name;
  • last name;
  • email address;
  • phone number;
  • password;
  • location;
  • professional data;
  • biometric data;
  • documents;
  • photographs;
  • videos;
  • payment methods;
  • tax or commercial data, if applicable.

The user is responsible for keeping their information up to date and protecting access to their account.

All activity carried out from an account is presumed to have been performed by its holder, unless proven otherwise.

6. USER TYPES

Handerr may recognize different user profiles:

6.1 Customer User

A person who uses Handerr to search for, request, contract, finance, pay for, rate, or receive services.

6.2 Professional or Provider User

A natural or legal person who offers services, products, solutions, jobs, repairs, assistance, consulting, or any permitted service within Handerr.

6.3 Verified User

A user who has completed additional validation processes defined by Handerr.

6.4 Commercial Partner

A company, business, institution, technological, financial, or strategic provider that delivers integrated or complementary services to Handerr.

7. MANNER OF SERVICE PROVISION

Handerr provides its services digitally, technologically, remotely, automatically, semi-automatically, or with assistance, as applicable.

Handerr's services may consist of:

  • enabling access to the application;
  • allowing profile creation;
  • facilitating service search;
  • displaying available professionals;
  • allowing urgent requests;
  • organizing results;
  • enabling chat;
  • recording agreements;
  • processing or registering payments;
  • offering artificial intelligence tools;
  • allowing positioning or visibility;
  • managing reputation;
  • offering support;
  • facilitating non-binding mediation;
  • connecting with third-party providers.

Services specifically provided physically, professionally, or commercially by provider users will be the exclusive responsibility of such users.

8. MAIN HANDERR FLOWS

8.1 Urgent Help

The user may describe an immediate need. Handerr may display the request to compatible, nearby, or available professionals.

Receiving applications does not guarantee absolute availability, exact response time, or a specific outcome.

8.2 Service Search

The user may search for categories, services, professionals, or businesses. Results may be organized according to location, relevance, reputation, availability, positioning, promotional payment, usage behavior, artificial intelligence, or other criteria.

8.3 Swipe-Style Discovery

Handerr may allow visual browsing of profiles or services through cards, recommendations, favorites, saved items, filters, or discovery systems.

9. ARTIFICIAL INTELLIGENCE

Handerr may use artificial intelligence to:

  • help describe problems;
  • improve requests;
  • suggest categories;
  • recommend professionals;
  • sort results;
  • draft profile biographies;
  • assist with reviews;
  • improve commercial texts;
  • detect inconsistencies;
  • support the user experience.

Responses, recommendations, texts, or suggestions generated by AI are indicative, automatic, and do not constitute professional advice, guarantee of results, or contractual obligation on the part of Handerr.

The user must review, validate, and confirm all information generated or suggested by AI before using it.

10. GEOLOCATION

Handerr may use location data to:

  • display nearby professionals;
  • sort results;
  • facilitate urgent help;
  • calculate coverage areas;
  • improve recommendations;
  • connect with nearby businesses or products in the future;
  • offer local positioning;
  • optimize the search experience.

The user authorizes the use of geographic information in accordance with the Privacy Policy.

Location accuracy may depend on the device, connection, permissions, maps, third parties, and user settings.

11. PROFILES, SHOWCASES, AND PROFESSIONAL CONTENT

Professionals may publish information such as:

  • service description;
  • experience;
  • photos;
  • videos;
  • reference prices;
  • location;
  • availability;
  • categories;
  • social networks;
  • certifications;
  • documents;
  • reviews.

The user guarantees that published information is real, lawful, verifiable, and does not infringe third-party rights.

Handerr may edit, hide, limit, or remove content it considers false, misleading, risky, offensive, illegal, or contrary to these terms.

12. AGREEMENTS BETWEEN CUSTOMER AND PROFESSIONAL

When a customer and a professional agree to the provision of a service, such agreement is understood to be entered into directly between them, unless Handerr expressly indicates otherwise.

The agreement may include:

  • service description;
  • price;
  • payment method;
  • date;
  • location;
  • scope;
  • materials;
  • warranties offered by the professional;
  • special conditions;
  • cancellations;
  • responsibilities.

Handerr may provide tools to record such agreement, but will not be a performing party of the material service unless expressly agreed.

The quote, acceptance, or registration within the app may serve as digital evidence of the conditions agreed between the parties.

13. PAYMENTS

Handerr may enable payments within the app or registration of payments made outside it.

Payments may be made through:

  • card;
  • bank transfer;
  • mobile payment;
  • PayPal;
  • wallets;
  • registered cash;
  • external financing;
  • other available methods.

The user acknowledges that some methods depend on external providers, banking entities, payment processors, gateways, wallets, financial services, or partners.

Handerr will not be responsible for failures, delays, blocks, reversals, freezes, rejections, commissions, withholdings, or policies applied by third-party payment providers.

14. HANDERR COMMISSION

Unless a promotion, exemption, special plan, or different written agreement applies, Handerr will charge the professional, provider, or corresponding user a commission equivalent to:

19% (includes VAT) on the amount actually received from the customer for each service, job, contract, sale, or transaction generated, facilitated, registered, or derived from Handerr.

The commission will apply to:

  • services paid within the app;
  • services agreed on Handerr and paid outside the app;
  • registered cash payments;
  • partial payments;
  • financed payments;
  • advances;
  • balances;
  • renewals;
  • additional services derived from the same request;
  • any income obtained by the professional as a direct or indirect consequence of a connection generated by Handerr.

Handerr may automatically deduct the commission, invoice it, charge it to the professional's wallet, deduct it from balances, request payment, or apply another permitted operational mechanism.

15. BANKING, GATEWAY, AND THIRD-PARTY FEES

Handerr's commission does not include, unless expressly indicated:

  • banking fees;
  • payment gateway charges;
  • card fees;
  • transfer costs;
  • wallet fees;
  • currency exchange costs;
  • financing charges;
  • chargebacks;
  • taxes;
  • withholdings;
  • administrative costs;
  • third-party penalties;
  • technology provider fees;
  • withdrawal, settlement, or conversion costs.

Such charges will be borne by the user, customer, or professional, or deducted from the settled amount, according to the payment method, country, provider, contracted plan, or applicable operational rule.

The user accepts that the final amount received may be less than the gross amount paid by the customer due to commissions, fees, taxes, withholdings, or third-party charges.

16. FEE ANNEX

Handerr fees may include:

16.1 Service commission

  • Standard commission: 19% (includes VAT) on the amount actually received from the customer.

16.2 Promotional plans

Handerr may offer promotions such as:

  • verified user;
  • 12 months without commission;
  • activation plans;
  • packages;
  • discounts;
  • positioning;
  • complementary digital services.

Promotions will be subject to conditions, validity, eligibility, and limits defined by Handerr.

16.3 Premium services

Handerr may charge for:

  • search positioning;
  • priority in urgent help;
  • internal indexing;
  • optimized profile;
  • showcase with photos and videos;
  • subscriptions;
  • advertising;
  • verification;
  • AI tools;
  • commercial services;
  • geolocation;

16.4 Modification of fees

Handerr may modify fees, commissions, or plans, notifying users through the app, email, website, or internal channels.

Modified fees will apply prospectively, unless the user expressly accepts their application to ongoing services.

17. CASH OR OFF-APP PAYMENTS

When payment is made in cash or outside Handerr, the professional must register the actual amount received on the platform when applicable.

Registration of external payments allows:

  • maintaining traceability;
  • calculating commissions;
  • supporting reputation;
  • issuing receipts;
  • controlling history;
  • improving ecosystem security.

Omission, falsification, or underreporting of payments may result in:

  • suspension;
  • loss of benefits;
  • collection of pending commissions;
  • account blocking;
  • profile removal;
  • legal or commercial actions.

18. FINANCING AND THIRD-PARTY PARTNERS

Handerr may integrate financing alternatives through third parties, including external platforms such as Cashea or other partners.

Financing will be offered, evaluated, approved, rejected, charged, and administered by the corresponding third party.

Handerr does not guarantee:

  • approval of financing;
  • specific conditions;
  • rates;
  • installments;
  • terms;
  • absence of charges;
  • credit decisions.

The user accepts that all financial obligations with third parties will be subject to the terms of such third parties.

19. SETTLEMENTS TO PROFESSIONALS

When Handerr collects funds on behalf of a professional, it may settle the corresponding amounts deducting:

  • Handerr commission;
  • banking charges;
  • gateway fees;
  • taxes;
  • chargebacks;
  • pending balances;
  • penalties;
  • adjustments;
  • withholdings;
  • third-party costs.

Settlement timelines may depend on:

  • payment method;
  • service verification;
  • customer confirmation;
  • fraud prevention;
  • banks;
  • gateways;
  • external providers;
  • operational availability.

Handerr may temporarily withhold funds when there is suspicion of fraud, dispute, breach, chargeback, claim, legal review, or operational risk.

20. CANCELLATIONS, REFUNDS, AND PAYMENT DISPUTES

Cancellation and refund conditions may vary according to:

  • type of service;
  • execution status;
  • agreement between the parties;
  • payment method;
  • professional's policy;
  • Handerr's policy;
  • third-party rules.

Handerr may facilitate review processes, but does not guarantee automatic refunds unless an applicable express policy exists.

Chargebacks, banking claims, or disputes initiated with third parties may result in blocks, withholdings, or adjustments to user accounts.

21. MEDIATION AND SUPPORT BETWEEN PARTIES

Handerr may offer, at its sole discretion, support, accompaniment, review, or non-binding mediation mechanisms between users when there is a disagreement related to a request, service, payment, rating, or experience within the platform.

Handerr's intervention may include:

  • receipt of claims;
  • review of messages (\*when applicable);
  • review of evidence;
  • request for additional information;
  • suggested solutions;
  • preventive suspension;
  • recommendation of agreements;
  • operational adjustments;
  • administrative closure of cases.

Handerr's mediation will always be:

  • voluntary;
  • operational;
  • non-judicial;
  • non-arbitral;
  • non-binding;
  • limited to information available within the platform;
  • without obligation of outcome.

Handerr will not be obligated to resolve private disputes, substitute competent authorities, impose final decisions, pay compensation, guarantee results, or assume responsibility for users' breaches.

Handerr's participation in mediation, support, or review does not imply acknowledgment of liability, guarantee, debt, fault, legal representation, or indemnification obligation.

The parties retain their right to resort to competent authorities when they deem it necessary.

22. REPUTATION, REVIEWS, AND RATINGS

Users may rate real experiences within Handerr.

Reviews must be truthful, respectful, and based on facts.

Handerr may use artificial intelligence to help draft reviews, but the user will be responsible for the final published content.

Handerr may moderate or remove reviews it considers:

  • false;
  • offensive;
  • discriminatory;
  • manipulated;
  • purchased;
  • extortionate;
  • contrary to these terms.

23. VERIFIED USER

Handerr may grant verified user badges or benefits.

Verification may include:

  • phone;
  • email;
  • identity document;
  • biometrics;
  • photograph;
  • commercial validation;
  • proof documents;
  • references;
  • history.

Being a verified user does not guarantee future conduct, absolute quality, absence of risk, or direct responsibility of Handerr for the user's actions.

24. PROMOTIONAL PROGRAMS AND 12 MONTHS WITHOUT COMMISSION

Handerr may offer promotional benefits, including commission-free periods.

When a 12-month commission-free benefit is granted, it may be subject to:

  • user validation;
  • compliance with rules;
  • proper use of the platform;
  • no payment evasion;
  • no fraud;
  • no underreporting;
  • no review manipulation;
  • payment of a valid promotion;
  • valid commercial conditions.

Handerr may suspend or revoke the benefit if it detects breaches, abuse, fraud, or use contrary to the purpose of the promotion.

The commission-free benefit does not eliminate banking charges, taxes, gateways, third-party costs, financing, subscriptions, premium services, or other expressly disclosed fees.

25. CHAT AND COMMUNICATIONS

Handerr may enable chat between users.

Chat must be used for purposes related to services, agreements, payments, and support.

The following is prohibited:

  • harassment;
  • threats;
  • discrimination;
  • sending illegal content;
  • sharing unsolicited sexual content;
  • committing fraud;
  • evading commissions;
  • sharing phone contacts;
  • capturing users off-platform in an abusive manner;
  • manipulating payments;
  • sending malware;
  • violating third-party rights.

Handerr may monitor, review, or limit communications when necessary for security, support, fraud prevention, legal compliance, or dispute resolution.

26. PLATFORM EVASION

Users must not use Handerr to connect and then deliberately evade commissions, payments, registrations, reputation, or platform security mechanisms.

Evasion may include:

  • agreeing within Handerr and paying outside without registering;
  • declaring lower amounts;
  • creating alternate accounts;
  • taking clients off-platform to avoid commission;
  • manipulating contact data;
  • artificially canceling requests to close off-platform.

Handerr may suspend accounts, collect pending commissions, withdraw benefits, limit visibility, or take legal or commercial measures.

27. USER CONTENT

The user retains rights over their image and content, but grants Handerr a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, host, reproduce, display, adapt, distribute, promote, and communicate such content within or outside the platform, for operational, commercial, promotional, advertising, technological, or service improvement purposes.

The user guarantees that they have sufficient rights over photos, videos, texts, trademarks, testimonials, and other published content.

If the user does not agree, they must send an email to soporte@handerr.com and write in the description "I do not grant Handerr the right to use my image and content free of charge".

28. INTELLECTUAL PROPERTY

All rights to Handerr belong to Handerr App S.A. or its licensors, including:

  • trademark;
  • software;
  • interfaces;
  • design;
  • code;
  • algorithms;
  • AI;
  • databases;
  • structure;
  • processes;
  • documentation;
  • logos;
  • trade names;
  • proprietary content.

Handerr Internacional S.A. may commercially exploit certain rights in Venezuela in accordance with its agreement with Handerr App S.A.

Copying, reproducing, modifying, distributing, exploiting, reverse engineering, cloning, or improperly using any Handerr element is prohibited.

29. COMPLEMENTARY DIGITAL SERVICES

Handerr or its partners may offer complementary services such as:

  • website;
  • SEO;
  • Google Business;
  • geolocation;
  • internal positioning;
  • indexing;
  • marketing content;
  • neuromarketing guides;
  • profile optimization;
  • photography;
  • video;
  • advertising;
  • commercial support.

These services may have specific conditions, fees, scope, timelines, and limitations.

Results regarding positioning, visibility, customers, traffic, or sales are not guaranteed, unless there is an express written promise.

30. PROHIBITED CONDUCT

The following is prohibited:

  • using Handerr for illegal activities;
  • publishing prohibited services;
  • creating fake accounts;
  • impersonating identities;
  • committing fraud;
  • sharing private phone data before the service request;
  • manipulating payments;
  • harassing users;
  • discriminating;
  • publishing offensive content;
  • maliciously damaging third-party reputation;
  • mass data extraction;
  • using unauthorized bots;
  • interfering with the platform;
  • selling accounts;
  • manipulating reviews;
  • evading commissions.

31. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Handerr App S.A. and Handerr Internacional S.A. will not be liable for:

  • users' breaches;
  • damages caused by professionals;
  • poor quality of services provided by third parties;
  • economic losses;
  • lost profits;
  • moral damages;
  • indirect damages;
  • interruptions;
  • third-party failures;
  • payment errors;
  • banking failures;
  • decisions based on AI;
  • conflicts between users;
  • false information published by users;
  • delays beyond its control;
  • results not obtained;
  • unmet commercial expectations.

Use of Handerr is at the user's own risk.

32. INDEMNIFICATION

The user agrees to hold harmless Handerr App S.A., Handerr Internacional S.A., their shareholders, directors, employees, representatives, partners, providers, and licensors from claims, damages, losses, liabilities, fines, costs, or fees arising from:

  • improper use of the platform;
  • breach of these terms;
  • services provided or received;
  • published content;
  • fraud;
  • violation of third-party rights;
  • commission evasion;
  • conflicts with other users;
  • legal or tax breaches.

33. TAXES AND FISCAL OBLIGATIONS

Each user will be responsible for complying with their applicable tax, fiscal, labor, commercial, municipal, professional, or regulatory obligations.

Handerr may issue invoices, receipts, reports, or documents in accordance with its operational model, but does not substitute the user's tax obligations.

34. SUSPENSION AND TERMINATION

Handerr may suspend, limit, or delete accounts when it detects:

  • breach;
  • fraud;
  • risk;
  • abusive use;
  • payment evasion;
  • false information;
  • recurring claims;
  • harmful conduct;
  • legal breach.

Suspension may involve loss of visibility, benefits, promotions, badges, or access to funds subject to review.

35. PLATFORM AVAILABILITY

Handerr will endeavor to keep the platform available, but does not guarantee uninterrupted, error-free, or permanent operation.

Interruptions may occur due to:

  • maintenance;
  • updates;
  • technical failures;
  • external providers;
  • connectivity;
  • force majeure;
  • cyberattacks;
  • regulatory decisions.

36. PRIVACY AND PERSONAL DATA

The processing of personal data will be governed by Handerr's Privacy Policy.

The user authorizes the processing of data necessary to operate the platform, including identification, contact, location, payment, reputation, behavior, content, and usage data.

37. MODIFICATIONS

Handerr may modify these terms, fees, functionalities, plans, benefits, commissions, or policies.

Modifications will be published through the app, website, email, or internal channels.

Continued use implies acceptance.

38. APPLICABLE LAW AND JURISDICTION

These terms will be governed by applicable laws according to the contractual structure defined by Handerr App S.A. and Handerr Internacional S.A., without prejudice to mandatory rules applicable to the consumer or user in the corresponding jurisdiction.

In case of dispute, the parties will first seek an amicable solution through direct communication or Handerr support.

When this is not possible, the dispute may be submitted to competent authorities, courts, or mechanisms in accordance with applicable jurisdiction, contractual domicile, country of operation, or specific agreement between the parties.

39. ANNEX A — MAIN FEES

A.1 Standard commission

19% (INCLUDES VAT) on the amount actually received from the customer for each service, job, contract, sale, or transaction generated, facilitated, registered, or derived from Handerr.

A.2 Charges not included

The following are not included in the standard commission:

  • banks;
  • gateways;
  • wallets;
  • cards;
  • chargebacks;
  • taxes;
  • withholdings;
  • currency exchange;
  • financing;
  • third-party fees;
  • special administrative costs.

A.3 Premium services

Handerr may charge additional fees for:

  • positioning;
  • verification;
  • advertising;
  • subscriptions;
  • SEO;
  • website;
  • Google Business;
  • geolocation;
  • marketing content;
  • neuromarketing guides;
  • optimized profile;
  • advanced AI;
  • training;
  • commercial services.

A.4 Promotions

Promotions may be modified, limited, or canceled by Handerr in accordance with their specific conditions.

40. ANNEX B — OPERATIONAL MEDIATION RULES

Handerr's mediation is an internal support mechanism intended to facilitate communication and review of conflicts.

It does not constitute arbitration, trial, legal advice, or a binding decision.

Handerr may close a case when:

  • there is insufficient evidence;
  • the parties do not respond;
  • there is bad faith;
  • the matter exceeds the scope of the platform;
  • it is necessary to resort to competent authorities.

Handerr will not assume responsibility for the outcome of mediation or for agreements breached between users.

42. FINAL STATEMENT
